The Planning Process

Overview

Four Things to Keep in Mind

Four Things to Keep in Mind

Cain Estate Law is about making the planning process seamless and intuitive. At its heart, estate planning codifies your wishes understandably and in a form the law honors. At its best, estate planning also brings you and your loved ones peace of mind.

The process begins when you indicate your interest and provide Tyson with the information necessary for drafting appropriate language. This information includes fundamentals like names, addresses, dates of birth, and an estimate of the market value of your property. After reviewing this information, Tyson will meet with you to discuss your preferences and concerns in more detail. Like all other conferences with Tyson, this one will occur virtually by video conference (Zoom) or by telephone.

When you and Tyson have settled on how your plan should read, Tyson will briefly take over the process by drafting your documents and delivering them to you. Although you must execute your documents on your own (remote execution is unfortunately not an option in Wisconsin), Tyson will provide detailed, easy-to-understand instructions about the signing process and follow up with you as necessary to ensure successful completion of your planning.

Four Things to Keep in Mind

Four Things to Keep in Mind

  1. Planning with Cain Estate Law affords you great flexibility. Attorney Tyson Cain will work with you to determine the level of planning right for you, whether this means a simple will or a revocable trust portfolio that includes powers of attorney to match the sophistication of your intent. He will never try to sell you more planning than you need.
  2. Wisconsin law will say who gets what, when, and how If you fail to make any valid plans of your own. (Make your own valid plans.)
  3. Part of the value of working with Tyson is the ability to get an affordable documents written quickly and without the hassle of working with a traditional firm. Part of the cost is having to execute your own documents with your own witnesses and public notary. Tyson will assist you with this process, but the legwork will be yours.
  4. As life evolves and laws are updated, your estate plan may also need to change. These changes are normally handled through amendments or a full revision of your documents. These amendments and revisions are generally easier to complete than planning anew, and also less expensive.
